Website owner, the offering, and binding of Terms

This website (www.bunneyandthread.com) is owned and operated by Bunney & Thread (“the Company”, “us”, “we”, or “our”). These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors one to one sewing machine, embroidery machine and embroidery software tuition, bespoke embroidery commissions and The Bunney & Thread Embroidery Club Membership. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

Key commercial Terms offered to customers

When buying an item or service, you agree that:

(i) you are responsible for reading the full item/service listing before making a commitment to buy it

(ii) you enter into a legally binding contract to purchase an item/service when you commit to buy an item/service and you complete the check-out payment process

The prices we charge for our products or services are listed on the website where appropriate. We reserve the right to change our prices for products/services displayed at any time, and to correct pricing errors that may inadvertently occur.

Due to the nature of one to one training in person - a quote for this service will be given once the location of the training has been confirmed and agreed upon.

One to One Tuition

​

Our method of training is relaxed, informal and bespoke to you. We will always ask along the way if you're happy with what we've explained or shown, and give you plenty of opportunity to have anything explained or covered again.
If you are not sure about something we've explained or shown, or would like to see something again, please let us know during the training. We would much rather show you something 100 times than you feel like you didn't learn what you needed to.

We will not tolerate any rude or abusive behaviour before, during or after training.

We reserve the right to cancel upcoming training, terminate training during the session and discontinue ongoing support if we experience such behaviour.

We understand that life happens and sometimes exceptional circumstances mean having to change or cancel plans. If you do have to cancel or reschedule any training, please get in touch via email - hello@bunneyandthread.com as soon as possible.

We will endeavour to be as flexible as possible but the following cancellation policy applies to all tuition and group sewing bookings:

 

• If you cancel your tuition or group sewing session less than 48 hours before it is scheduled to take place, you will still be charged in full.

 

• If you cancel your tuition or group sewing session more than 48 hours before it is scheduled to take place, you will still be charged in full and we will reschedule the session with you.

 

• If you cancel your tuition or group sewing session more than 7 days before it is scheduled to take place, you can receive a full refund or reschedule.

 

• If we have to cancel, we will give you as much notice as possible and liaise with you to reschedule the session. If an alternative date cannot be found you will receive a full refund.

The Bunney & Thread Embroidery Club

​

• The Bunney & Thread Embroidery Club is an auto-renew subscription membership which can be cancelled at any time.

• Club members are responsible for their own login details to gain access to the private Members Area.

Bunney & Thread grants you permission to use the website and Members Area as set forth in these Terms of Use, provided that:

​

(i) you have paid fees, if required, to enroll in any subscription

(ii) you have set up a valid account and Profile (as defined below)

(iii) your use of the website, as permitted, is solely for your personal, noncommercial use

(iv) you will not copy, upload, republish or distribute any part of the website or the Members Area in any medium without Bunney & Thread's prior written authorisation

(v) you will not alter or modify any part of the website or Members Area other than as may be reasonably necessary to use the website and Members Area for their intended purpose

(vi) you will not reverse engineer or disassemble any element of the website or Members Area

(vii) you are at least 18 years of age

(viii) you will otherwise comply with Terms of Use

In order to access the Members Area, you will have to create an account. You may never use another person's account without their permission and you may not provide another person with the username and password to access your account. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Bunney & Thread immediately of any breach of security or unauthorised use of your account. Although Bunney & Thread will not be liable for your losses caused by any unauthorised use of your account, you may be liable for the losses of Bunney & Thread or others due to such unauthorised use.

You agree not to collect any personally identifiable information, including account names, from the website or Members Area, nor to use the communication systems provided by the website or Members Area for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the website.

The website may contain links to third-party websites that are not owned or controlled by Bunney & Thread. Bunney & Thread has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. In addition, Bunney & Thread will not and cannot censor or edit the content of any third-party site which is linked to the website. By using the website, you expressly relieve Bunney & Thread from any and all liability arising from your use of any third-party website. Accordingly, we encourage you to be aware when you leave the website and to read the terms and conditions and privacy policy of each other website that you visit.

The private Members Area will allow you to access certain materials and functionality available on the website.

Bunney & Thread reserves the right to amend or withdraw any subscription/membership at any time and for any reason.

​

Bunney & Thread does not accept any responsibility whatsoever for unavailability of the website or Members Area, or any difficulty or inability to download or access content or any other communication system failure which may result in the Members Area being unavailable. Bunney & Thread will not be responsible for any support or maintenance for the Members Area.

The Bunney & Thread Embroidery Club members will be notified of new events/content (such as, but not limited to - Masterclasses, Q&A sessions, Guest Speakers, Sew Along Projects etc) and will have access to an ongoing schedule of events/content. Bunney & Thread reserves the right to amend this schedule as and when necessary and all members will be notified of any change as soon as it's possible to do so. Bunney & Thread also reserves the right to put live events/content on hold during periods of illness, emergency, holiday etc. and your subscription will remain active unless cancelled by you.

The Bunney & Thread Embroidery Club aims to be as member led as possible and will regularly ask for feedback and comments, requests and votes for Masterclasses etc. While every effort will be made to accommodate every suggestion and request - this may not always be possible to achieve.

 

Return and refund policy

For any undamaged, un-personalised product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following:

(i) Products can be returned only in the country in which they were originally purchased

(ii) The following products are not eligible for return:

• Bespoke or personalised items

• Items that have been worn / used

To receive a refund for any booked tuition or group sewing session, I must be notified at least 7 days before it is scheduled to take place. I reserve the right to retain full payment if cancellation is made less than 7 days before the training is due to take place, however every attempt will be made to reschedule the training.

 

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

Warranties & responsibility for services and products

When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.

 

 

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Bunney & Thread. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You recognise and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

 

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

 

Indemnification

You agree to indemnify and hold Bunney & Thread harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Bunney & Thread, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Bunney & Thread assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. If we do make changes, we’ll post any changes on this page. If you continue to visit our site after those changes are in effect, you agree to the revised policy. If the changes are significant, we may provide more prominent notice or get your consent on the new policy. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

 

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – you can unsubscribe at anytime using the "Unsubscribe" link at the bottom of any Bunney & Thread newsletters, or notify us at any time by email.
